NERVIAL LABS publishes and operates the SmartAGT platform. In this legal notice, “SmartAGT” refers to the trademark and the platform operated by NERVIAL LABS.

Article 4: Intellectual property

This entire website, including its structure, visual identity, texts, logos, illustrations, source code and editorial content, is protected by copyright and trademark law. These elements are the exclusive property of NERVIAL LABS, publisher of SmartAGT, or of its licensors. Any reproduction, representation, modification, publication, transmission or alteration, in whole or in part, by any means whatsoever, without the prior written authorisation of NERVIAL LABS, is prohibited and constitutes an infringement punishable under Articles L335-2 et seq. of the French Intellectual Property Code.

Third-party trademarks, trade names, logos and distinctive signs referred to or displayed on this website, in particular those of artificial intelligence model providers, infrastructure services and business software, remain the exclusive property of their respective owners. They are cited for information purposes only, to illustrate the technical compatibilities of the SmartAGT platform, and may under no circumstances be construed as an affiliation, a partnership or a commercial endorsement, unless expressly stated otherwise.

Article 5: Hyperlinks

This website contains hyperlinks to other websites, in particular press articles, the platform documentation and the appointment booking service. SmartAGT exercises no control over third-party websites and disclaims any liability as to their content and their data protection practices.

Creating links to smartagt.ai from a third-party website is permitted provided that it does not harm the image or the rights of SmartAGT and that it clearly identifies the source.

Article 6: Personal data protection

6.1 Data controller

The data controller is NERVIAL LABS, publisher of SmartAGT, whose contact details are set out in Article 1.

6.2 Data collected and purposes

The website contains no collection form and does not directly collect any personal data. Two situations may lead to the processing of your data:

• Booking a demonstration. The “Book a demo” buttons open, in a new tab, the Microsoft Bookings page of NERVIAL LABS. The information you enter there (name, email address and, where applicable, the content of your message) is processed for the sole purpose of arranging and preparing the requested appointment.
• Contacting us by email. If you write to contact@smartagt.ai, the data contained in your message is processed for the sole purpose of answering your request.

6.3 Legal basis

This processing is based on the performance of pre-contractual measures taken at your request (Article 6(1)(b) GDPR).

6.4 Recipients and processors

The data is intended for the internal sales and technical teams of NERVIAL LABS authorised to handle your request. It may be processed by our technical processor Microsoft Corporation (Microsoft Bookings service, receipt and storage of emails through Microsoft 365), acting on our behalf and on our instructions. No data is sold, rented or passed on to third parties for commercial purposes.

6.5 Retention period

Data is kept for three (3) years from the last contact. At the end of that period, it is deleted or archived in accordance with applicable legal obligations.

6.6 Transfers outside the European Union

Data relating to appointment booking and email exchanges is hosted within the European Union. As our processor Microsoft is established in the United States, certain administration and technical support operations may involve access from a third country. Such transfers are governed by the standard contractual clauses adopted by the European Commission and by the contractual data protection commitments entered into by Microsoft. You may obtain a copy by writing to contact@smartagt.ai.

6.7 Your rights

In accordance with the GDPR and French Act No. 78-17 of 6 January 1978 as amended, you have the right to access, rectify, erase, object to, restrict the processing of and port the data concerning you. You may exercise those rights at any time by writing to contact@smartagt.ai or to the postal address of the registered office set out in Article 1. NERVIAL LABS undertakes to reply within one (1) month of receipt of your request, in accordance with Article 12(3) GDPR.

6.8 Complaints

If you consider that your rights are not being respected, you may lodge a complaint with the French data protection authority (CNIL), 3 place de Fontenoy, TSA 80715, 75334 Paris Cedex 07, France, or at www.cnil.fr.

Article 7: Cookies and local storage

The smartagt.ai website uses no audience measurement, advertising or profiling cookies, and calls on no third-party tracking service. It only stores the following items, all of which are necessary for a feature you have requested yourself:

• The lang cookie, set when you choose a language with the FR / EN switcher, in order to remember that choice on your subsequent visits. Retention period: one year.
• The smartagt-site-color-mode local storage entry, which remembers your display preference (light or dark theme).
• The smartagt-404-best local storage entry, which remembers your best score in the error page mini-game, only if you play it.

This data remains on your device and is not transmitted to any third-party server. It is strictly necessary for the provision of a service expressly requested by you, within the meaning of Article 82 of the French Act of 6 January 1978 as amended: its use therefore does not require your prior consent.

The Microsoft Bookings page, opened in a new tab, is a third-party website: the cookies it sets are governed by Microsoft's privacy policy.

Article 8: Governing law and jurisdiction

This legal notice is governed by French law. In the event of a dispute and failing an amicable settlement, the competent courts shall be those having jurisdiction over the registered office of NERVIAL LABS.
